Training Agreement

Welcome to the Santé Cannabis Prescriber Training Program.
Please read and complete the agreement below to accept the program’s terms and conditions.

PRESCRIBER TRAINING PROGRAM AGREEMENT

The Santé Cannabis Prescriber Training Program aims to provide medical cannabis education and support services for health care providers and trainees.

It includes two key features described below:

  • Online Training Portal: Containing self-learning modules, videos, mentorship and preceptorship opportunities via a hosted web portal, providing access to the available evidence on the therapeutic use of medical cannabis and access to resources and clinical tools to create prescriptions, perform clinical assessments, create treatment plans and referrals;
  • Support Services: A host of support offerings to support continued medical education, including a phone support line to Santé Cannabis nursing team, access to shared-care education services for your patients, webinars, preceptorships and onsite continuing training opportunities.

The Program also provides opportunities to customize your interactions by signing up for email notifications and e-newsletters, as well as event invitations and opportunities to learn about and get engaged in a variety of knowledge translation activities such as webinars or research studies.

ACCEPTANCE

This Terms of Use Agreement (“Agreement”) is a legal agreement between you and Santé Cannabis, the owner and operator of the Santé Cannabis Prescriber Training Program (the “Program”) and the Online Training Portal (the “Portal”).

It states the terms and conditions under which you may access and use the Program services and the Portal. By accessing and using these services, you are indicating your acceptance to be bound by and comply with the terms and conditions of this Agreement. Santé Cannabis may revise this Agreement at any time by updating this posting. Use of the Portal after such changes are posted will signify your acceptance of the revised terms. You should visit this page periodically to review this Agreement.

 USE OF PORTAL AND SUPPORT SERVICES

The information provided in the Program is for information purposes only and aims to support healthcare professionals with the background knowledge required to make treatment decisions for their patients. It is not professional medical advice, diagnosis, treatment or care nor is it intended to be a substitute for these services. Medical cannabis remains an unapproved medical treatment in Canada, and reference to off-label use of cannabinoid-based pharmaceutical medications is indicated throughout the Program. The Portal and support services within the Program are available for reference but are not to be used for medical emergencies.

NO PRESCRIBER-PATIENT RELATIONSHIP

The presentation of general information within the Program does not establish a prescriber-patient relationship between you and Santé Cannabis (or any of its prescribers) and is not intended as a solicitation of individuals to become patients or clients of Santé Cannabis (or any of its prescribers).

NO DUTY OF CARE

The presentation of Content on the Portal and as part of the Program, including discussions between healthcare professionals using the Portal, does not establish a duty of care between you (or your patients) and Santé Cannabis (or other healthcare professionals using the Portal) and is not intended as a solicitation.

NO ENDORSEMENTS

The development of the Portal and the Program services has been support by unrestricted educational grants provided by commercial and non-profit organizations. Santé Cannabis does not recommend or endorse any specific brand of products, services, procedures or other information that appears or that may be advertised on the Portal. The Portal and associated Program services provide a summarized version of published and practice evidence. Furthermore, while the information provided has undergone internal peer review by healthcare professionals and research personnel at Santé Cannabis, it does not represent a systemic review or meta-analysis of the literature. As medical cannabis is an unapproved treatment, no Drug Product Monograph is available and a rigorous assessment of the quality and veracity of available clinical data was not performed and a data quality score was not assigned. Santé Cannabis makes no warranty of the accuracy, validity or completeness of the information provided in the Portal and the Program.

PRIVACY POLICY
By participating in the Program, you are agreeing to the sharing of information between Santé Cannabis and specific program partners regarding participant activity and utilization of support services within the program. All such data is anonymized and registration information will not be shared with third parties unless specifically named in this agreement. If you are a nurse practitioner in Quebec, you are agreeing to the sharing of information between Santé Cannabis and OQP en santé (Centre d’Optimisation de la qualité de la pratique en santé) regarding your participation within the PTP program. Santé Cannabis may contact you in the future with surveys to determine the impact of your participation in this Program on your practice. No confidential, or otherwise identifiable patient information will be shared as part of this Program without the express consent of the respective patient.

LIMITATION OF LIABILITY, RELEASE AND INDEMNITY

Subject to applicable law, in no event shall Santé Cannabis and its partners, employees, consultants, agents or licensors be liable for damages of any kind including, without limitation, any direct, special, indirect, punitive, incidental or consequential damages including, without limitation, any loss or damages in the nature of or relating to lost business, lost savings, lost data and/or lost profits arising from your use of, reliance upon, or inability to use the Portal or the Program in general, regardless of the cause and whether arising in contract (including fundamental breach), tort (including negligence), or otherwise. The foregoing limitation shall apply even if Santé Cannabis knew of or ought to have known of the possibility of such damages.

You hereby agree to release Santé Cannabis and its partners, employees, consultants, agents and licensors from, and in no event shall any or all of Santé Cannabis and its partners, employees, consultants, agents or licensors be liable to you or any other person or entity, for any and all liabilities and damages (including any direct, indirect, special, exemplary or consequential damages, including lost profits) whatsoever arising from your use of the Portal (including any breach by you thereof), the Content or otherwise relating to this Agreement and you agree that your sole remedy for any claim, loss, damage, costs or expenses is to cease using the Portal. You will indemnify and hold harmless Santé Cannabis and its partners, employees, consultants, agents or licensors from and against any claims, losses, judgments, damages, costs and expenses (including without limitation, reasonable legal fees) incurred by any of them due to or resulting from your use of the Portal, the Content or otherwise relating to this Agreement (including any breach by you thereof). You will also indemnify and hold harmless Santé Cannabis and its partners, employees, consultants, agents or licensors from and against any claims brought by third parties arising out of your use of the Portal or its Content. To effectively operate its Portal, Santé Cannabis occasionally uses external service providers, however, all data is hosted within Canada and in compliance with applicable legislation.

REGISTRATION AND FEES

Currently, and upon registration, all licensed physician and specialized nurse practitioner participants based in Quebec and in British Columbia have a free, non-exclusive license to use the Prescriber Training Program Portal and available Support Services as described in the Portal. Other healthcare professionals may be offered access to the Portal or and may access specific Support Services or “Add-On Services” upon payment of nominal fees.

Registration in the Portal allows you to more fully participate in some programs, and is required for access to the online training modules and participation in the online prescriber communities. It allows you to sign up to receive email notifications, post comments and participate in discussion forums. By registering, you agree that you will i) provide true, accurate, current and complete information about yourself as prompted by any registration form; and (ii) maintain and promptly update the information to ensure it remains true, accurate, current and complete. Any passwords and user IDs used for this Portal are for individual use only. You are responsible for maintaining the confidentiality of the password and account, and for all activities that occur under your account. In consideration of use of the Portal, you agree to maintain and update true, accurate, current and complete Registration Data. If you provide any information that is untrue, inaccurate, not current or incomplete, or if Santé Cannabis has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Santé Cannabis may suspend or terminate your account and refuse any and all current or future use of the Portal or any portion thereof.

WITHDRAWAL

You may withdraw your participation in the program at any time by providing written notice to Santé Cannabis at prescriber@santecannabis.ca or by mail: 225-4150 Ste-Catherine O., Montreal, QC H2Y 3Z5.
